Privacy Policy

FORCYD B.V. including all its EEA and Non-EEA entities (hereinafter: ‘FORCYD’, ‘we’, ‘us’, ‘our’) is a provider of eDiscovery, Cyber Forensics and Document Review staffing services. As part of our service delivery for Document Review staffing services we are using a Document Review Network where you as a potential contractor can sign up for. FORCYD acts as a Data controller for the purposes of this Document Review Network including the processing of recruitment Data, contractor Data and business administrative Data. At FORCYD we are committed to maintaining the accuracy, confidentiality, and security of your Personal Data. The provisions detailing how we do that are included in this Document Review Privacy Policy (‘Policy’), so we are kindly asking you to read these carefully. 1. Scope

This Policy describes the types of Personal Data that FORCYD may collect or process, how we may use and disclose that Personal Data, and how you may exercise any rights you may have regarding the processing of your Personal Data.

This Policy applies to Personal Data collected or processed by us online (through our websites, applications, and otherwise), when we provide products or services to you, and in other situations where you interact with us, including anywhere this Policy is posted or referenced (products, services, websites, and other systems will be referred to in this Policy as “Products and Services”). This Policy also applies to Personal Data that is collected or processed when you interact with us in-person, by telephone, or by mail.

If you provide Personal Data of anyone other than yourself, please note that you are responsible for complying with all applicable privacy and Data protection laws prior to providing that information to FORCYD (including obtaining consent, if necessary and required).

To the extent permitted by applicable law, by providing us your Personal Data or otherwise interacting with us, you are agreeing to this Policy.

We do not sell or rent any Personal Data that we process about you. Certain actions, such as signing up for a newsletter, require processing by third parties and any Personal Data that you submit for these purposes will redirect to them and be governed by their privacy policies.

2. Personal Data

Personal Data means any information that identifies you as an individual. This includes your name, email address, curriculum vitae’s, personal device ID’s, location, and more. FORCYD collects only Personal Data necessary to allow you to access our website, receive FORCYD email alerts, become part of the FORCYD document Review Network, apply for roles and conduct services on behalf of FORCYD when contracted.

3. How Your Personal Data Is Collected

Personal Data may be obtained through our websites (e.g. when you register in our Document Review Network and submit your curriculum vitae or application) or via one of our consultants (e.g. when you contact them, send them your curriculum vitae or application, connect with them on LinkedIn or similar professional networking sites, or discuss an assignment opportunity with them).

Although we have implemented reasonable measures to protect your Personal Data, we cannot guarantee the security of your Data transmitted to us using the internet – any such transmission is at your own risk and you are responsible for ensuring that any Personal Data that you send to us are sent securely.

4. Storage And Security Of Your Personal Data

Safeguarding Personal Data and respecting confidentiality of your Data is important to FORCYD. All Personal Data you provide to us is stored on secure environments and we are responsible to take the necessary steps, including putting in place adequate technical and organizational controls, to protect your Personal Data. While we have security measures in place to protect against the loss, misuse and alteration of Personal Data under our control we cannot guarantee that loss, misuse or alteration of Personal Data will not occur.

While FORCYD proactively takes security measures to protect your account information, it is your personal responsibility to actively protect your account information by protecting your password and other information from unauthorised access.

If you suspect that someone else may be aware of your FORCYD password, please change it immediately or contact us at privacy@forcyd.com.

5. Disclosure Of Your Personal Data

In the course of providing our services we may need to disclose your Personal Data to other companies (including to trusted third parties) for the purposes for which it is primarily held or for a related or secondary purpose. We may:

  • for the purposes of providing potential assignments to you, pass your Personal Data to the involved FORCYD employees or consultants.
  • disclose or transfer your Personal Data to contracted clients where your profile is a prospective fit for an assignment.
  • disclose your Personal Data to trusted third parties who perform services on our behalf, such as professional advisors, background screening providers (reference/qualification checking) and IT consultants carrying out testing and development work on our business technology systems.

We may disclose Personal Data, if required to do so by law, a court order or by a regulatory authority of competent jurisdiction or if we believe that such action is necessary to protect, defend or enforce the rights of FORCYD.

6. Transferring Personal Data Across International Borders

Where you are registered as a candidate on our Document Review Network, your Personal Data may be accessible by or transferred or duplicated to our offices and consultants globally to enable them to provide you with our services and for the purposes mentioned in this Policy.

Where you apply for assignments with clients based outside the country from which you are applying, your Personal Data may be sent to clients in that country.

By submitting your Personal Data to us, you are agreeing to your Personal Data being transferred to our offices, including our international offices at the locations listed above and where you are applying for roles outside the country of application, to prospective clients in those countries.

7. Your Personal Data Rights

You have certain rights regarding your Personal Data, including the right to confirm whether or not we are processing your Personal Data. In the event you wish to view, receive a copy of, update, correct, or delete your Personal Data in FORCYD possession at any time for any reason, please contact privacy@forcyd.com to take those actions.

You also have the right to ask FORCYD to stop using your Personal Data. However, if this involves a request for deletion of your file, please be aware that we may not be required or able to do so, particularly where your file also holds information about our clients or financial information that we need to keep for periods of up to six years i.e. that relate to tax matters. Where we are unable to comply with your request, we will provide reasons.

8 Making A Complaint

If you believe that we have breached this Policy, or any other applicable privacy or Data protection laws or regulations which may apply to FORCYD, then you should make a complaint to FORCYD in the first instance. You should address your complaint in writing to us at privacy@forcyd.com, and you should include as much detail as you can about the Personal Data affected, and the circumstances that you believe amount to a breach of this Policy or the applicable privacy or Data protection law or regulation.

We will undertake an internal investigation, and we may contact you if we need to obtain any further information in relation to your complaint. We will generally provide a written response to your complaint within 30 days. Our response will set out the results of our investigation, including whether we agree that FORCYD has breached this Policy or applicable privacy or Data protection laws or regulations.

If you are unhappy with our response to your complaint, you have the right to make a complaint to the relevant regulatory body.

9 Changes To Our Policy

This Policy may be amended or updated from time to time to reflect changes in our practices with respect to the processing of Personal Data, or changes in applicable law. We encourage you to read this Policy carefully, and to regularly check this page to review any changes we might make in accordance with the terms of this Policy.
